1. Notice of Cancellation

   • Cancellation requests will be processed on business days during our regular working hours.

2. Time of Cancellation

   • Before Project Commencement: If cancellation is requested before work commences or before any licenses, hosting, or third-party services have been purchased, there will generally be no cancellation fee.

   • Ongoing Projects: If cancellation is requested after work has begun, you may be subject to a partial fee, determined by the percentage of the work completed at the time of cancellation.

3. Service-Specific Agreements

   • Some services may have specific cancellation clauses (e.g., monthly retainers, maintenance contracts). In such cases, please refer to the terms outlined in your individual agreement or statement of work, which will take precedence over this general Policy.

3. Refund Policy

1. General Refund Terms

   • Refunds are granted only in exceptional circumstances. These circumstances include, but are not limited to, non-delivery of service or if we have not commenced the work and have not purchased any third-party products or services on your behalf.

2. Deductions and Costs

   • Any refunds will be processed net of payment gateway fees and any other applicable charges incurred by BhaiBen in the process of receiving or refunding your payment.

   • If any third-party costs (e.g., domain registration, hosting fees, stock images, plugins) have already been incurred, these costs will be deducted from any eligible refund.

3. Timeframe for Refunds

   • Approved refunds will be processed within 7 business days of refund confirmation. The exact time it takes for you to receive the funds may vary based on your financial institution.

4. Non-Refundable Services

   • Completed Milestones: Payment for completed or delivered milestones is non-refundable.

   • Digital Products and Licenses: Any digital or software licenses purchased on your behalf are non-refundable once obtained.

   • Marketing & SEO Services: Due to the nature of digital marketing and SEO, which involves upfront expenses, manpower, and strategy, we do not provide refunds for partially completed campaigns unless otherwise stipulated in your contract.

4. Force Majeure

In rare cases, events outside of our reasonable control—such as natural disasters, government actions, or acts of God—may cause unforeseen delays or interruptions in service delivery. BhaiBen shall not be held liable for any refunds or failures to deliver services in such circumstances.

5. Dispute Resolution

If any disputes arise regarding cancellations or refunds, both parties agree to attempt resolution through amicable negotiation. If such negotiation fails, disputes will be subject to arbitration in Gandhinagar, India. If arbitration is unsuccessful, both parties consent to the exclusive jurisdiction of the courts located in Gandhinagar, Gujarat.

We reserve the right to modify or update this Cancellation & Refund Policy at any time. Changes will be posted on our website and will take effect immediately upon posting. We encourage you to review this Policy periodically to stay informed of any updates.
